Living Trust – Your living trust is meant to include all of your assets. In addition to having direct input in how your assets are distributed after you pass away, a living trust also avoids probate, provided it is correctly funded.
Pour-Over Will – Your pour-over will is a catch-all document that transfers anything that was not already placed into the trust directly into the trust itself.
Durable Power of Attorney – This document allows you to designate individuals you would like to make financial decisions for you. This is critical in the event you are incapacitated or unable to handle matters on your own. A “durable” power of attorney remains in effect if you become incapacitated, whereas a “general” power of attorney automatically ends if you lose mental capacity.
Healthcare Power of Attorney – This document allows you to designate individuals to make healthcare decisions for you, usually in the event of your incapacitation. This is a critical document to have, especially now, as hospitals are currently limiting visitors to parents or those who have a Healthcare Power of Attorney.
Living Will – A living will is a healthcare directive that allows individuals to state their wishes for end-of-life medical care.
